Terms of Service

1. Agreement to Terms & Ownership

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Player," or "you") and TheMarketBug LLC ("TheMarketBug," "Company," "we," "us," or "our"), governing your access to and play of the tactical card game Aevendorn, its web clients, applications, content, and related services at aevendorn.com (collectively, the "Services").

By loading the landing page, clicking "Play Free", creating an account, or interacting with any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

2. Intellectual Property Rights

The Services, including all creature card illustrations, character designs, 3D holographic shaders, audio compositions, visual effects, software code, user interface designs, world lore, and brand names—including Aevendorn™, Confluence Arena™, and Bloodline Fusion™—are the exclusive intellectual property of TheMarketBug LLC and its licensors.

You may not copy, modify, distribute, reverse engineer, decompile, extract source code, sell, or create derivative works from any portion of the game without prior express written permission from TheMarketBug LLC.

3. Virtual Items, Booster Packs & Currency

Aevendorn features digital collectible creature cards, digital booster packs, and in-game virtual currency known as Aether Shards ("Virtual Items").

• Limited License: Virtual Items are not real property and carry zero real-world cash value. You receive a limited, revocable, non-transferable license to utilize Virtual Items solely within the Game environment.
• No Cash Redemption: Virtual Items cannot be redeemed for legal tender, real currency, cash equivalents, or tangible physical merchandise from TheMarketBug LLC.
• All Transactions Final: Any optional purchases of Aether Shard bundles or digital booster packs are final, non-refundable, and non-exchangeable, except where required by applicable consumer law.
• Right to Balance: TheMarketBug LLC retains the absolute right to manage, regulate, control, modify, rebalance, or eliminate Virtual Items, creature stats, passive traits, or shard costs at its sole discretion for game health and competitive balance, with zero liability to you.

4. Non-Destructive Bloodline Fusion & Game Mechanics

Aevendorn's proprietary Bloodline Fusion feature allows commanders to splice two parent creature cards to generate a genetically unique chimera card.

In accordance with our core design, fusion is non-destructive—both original parent cards remain permanently in your vault. Fused chimeras are subject to active Fair-Play Resonance limits (maximum 24 squad resonance) for competitive queue participation. Any attempt to exploit state-synchronization bugs to bypass resonance caps is considered a violation of fair play.

5. Player Marketplace & Trading Conduct

The in-game Player Marketplace provides a closed virtual escrow environment for players to exchange digital cards for Aether Shards or direct buy amounts.

• All marketplace listings and exchanges occur strictly within the game's virtual database.
• Off-platform trades, third-party cash sales ("real-money trading" or RMT), and unauthorized black-market transactions are strictly prohibited and will result in immediate termination of involved accounts.
• TheMarketBug LLC is not responsible for player-to-player trade regrets, mistaken listings, or typographical price entries made by players.

6. Prohibited Activities & Anti-Cheat

You agree not to engage in any of the following prohibited behaviors:

• Cheating & Botting: Utilizing unauthorized scripts, bots, macro automation, packet injection, memory scanners, or modified web clients to automate combat actions or gain unfair advantages.
• Service Disruption: Launching denial-of-service (DoS/DDoS) attacks, flooding API endpoints, or degrading server performance.
• Exploitation: Knowingly exploiting combat calculation bugs, duping glitches, or database desynchronization errors rather than reporting them to our security team.
• Account Impersonation: Falsely representing yourself as an employee, representative, or affiliate of TheMarketBug LLC or Aevendorn.

TheMarketBug LLC reserves the right to suspend, reset, or terminate access for any account found violating these fair-play provisions without notice or compensation.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THEMARKETBUG LLC DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF VIRUSES OR HARMFUL CODE, OR THAT DEFECTS WILL BE TIMELY CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THEMARKETBUG LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR VIRTUAL ASSETS) ARISING OUT OF OR CONNECTED WITH YOUR ACCESS TO OR USE OF THE SERVICES.

IN NO CASE SHALL THE TOTAL AGGREGATE LIABILITY OF THEMARKETBUG LLC ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY FOR DIGITAL GOODS IN THE PRECEDING THREE (3) MONTHS, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).

9. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be resolved through binding, confidential arbitration administered in accordance with standard commercial arbitration rules, rather than in court. You agree to waive any right to participate in class actions or class-wide arbitration.
